Hugh J Ward & Co. Solicitors work to make the process of debt management as simple as possible. Read through this list of frequently asked questions and then if required, please contact the office for further information.

How do I pay my debt?

Pay online

Pay with a debit card by clicking on any of the Pay Online buttons on this website

Be sure to include your reference number with your payment details. Failure to do so may delay allocation of payment to your account.

Pay by phone:

Call us over the phone on the number included on the letter you received from us.  Our team will be willing to assist you with any queries you might have.

Pay by bank lodgement and transfer:

Lodge payments into any AIB bank or via bank transfer from your own bank. Our bank details are on our communication to you.

Pay by cheque, bank draft or postal Order:

Send cheques or postal orders to 9 Seville Place. Dublin 1  quoting the reference number in your recent correspondence. All cheques and postal orders should be made payable to Hugh J. Ward & Co.

How did Hugh J. Ward & Co. get my details?

As part of your T&C’s with our client for supplying their services to you, it will have stated that they may pass your information on to a 3rd party for bill collection purposes. If you wish to view the full terms and conditions of our client, please visit their website. We, Hugh J. Ward & Co., are fully compliant with GDPR, and confirm that your data is secure and:

  1. We have obtained and processed your data lawfully, fairly and in a transparent manner: – Your data was provided to us by our client in accordance with their Terms and Conditions.
  2. Your data is processed by Hugh J. Ward & Co. for only specified, explicit and legitimate purposes.

If you are in dispute about the balance being pursued, we are happy to assist you with any query that you may have.

This is not my debt, what shall I do?

If you do not recognise the account we have written to you about, please contact us and we will investigate.

Who are Hugh J. Ward & Co. and why are they contacting me?

We are a legal firm that provide legal Debt Recovery services on behalf of our creditor clients.

I have already paid, what should I do?

If you have already paid the debt then please contact us on the number stated on the letter or email which you have received. We will liaise with your creditor and investigate. Please have the details available of the payment’s you have made.

I believe the amount stated as due is wrong, what should I do?

If you do not recognise the amount, please contact us and we will investigate. Please note that some of our clients add additional charges once the account is placed with us. Once proceedings are issued to you, court costs are added to the balance.

Where do I find my reference number?

You can find your reference number on the left-hand side of the letter you received from us, just below the date and above the title.

How do I contact your office?

What details do I need to provide when contacting the office?

When contacting our office, please provide your reference number and your full name or address. If you are calling on behalf of a company or another individual, include their details as well. If the person handling your case is unavailable, it is helpful to provide a phone number, so we can call you back.

Can someone else make inquiries on my behalf?

In accordance with GDPR, we are not permitted to discuss any details of your debt with another party without your written authority. If you wish for someone to speak to us on your behalf, we will require you to provide written consent, providing our office with the details of the person who will be making inquiries on your behalf. authorising our office to discuss the details of your debt with the authorised third party.

Is my information confidential?

Yes, your information is confidential and will not be shared [ / disclosed] without your written consent or unless there is a legitimate legal basis to do so.

What happens if I miss a payment?

You should contact us to arrange to pay the missed payment as soon as possible. If you have agreed to a payment plan with our office, we will notify you of the missed payment prior to taking any further legal steps. If you do not engage with us following our notification further legal action maybe taken.

Can I set up a payment plan?

Yes, you can set up a payment plan with our office. Please note that unless a formal agreement has been acknowledged by our office on behalf, payments made to our office will not be considered as a binding payment plan on our client.

I have received a legal demand, what do I do to stop further legal action?

If you have received a legal demand for payment, please contact our office to arrange for payment.

I can’t afford to pay in full now, what can I do to stop further action?

In the event you cannot pay in full our client may facilitate a payment plan.

I received a letter to my address but the person no longer lives here, what do I do?

Please contact our office to notify us of the change in occupation of the address. In the event you are aware of a forwarding address of the addressee, please notify us of same. Alternatively you can return the letter by post advising the addressee is no longer at the address

I have already contacted the creditor and agreed to pay, why did you contact me?

If you have agreed payment with the Creditor directly, please notify us of the details of the agreement and we will confirm same with the Creditor. We will take the necessary steps to ensure the debt is paid in accordance with the Creditor’s instructions.

I do not owe the money, why did you contact me?

If you believe you do not owe the money which is being claimed by the Creditor, please contact our office so we can investigate the matter with the Creditor.

I have already dealt with the creditor and resolved this, why are you contacting me?

If you believe you have resolved the debt at issue with the Creditor, please contact our office to discuss the matter. We will investigate with the Creditor and notify you accordingly.

I want to speak with someone about the debt but work full time, can I arrange a time for a call?

Please email our office at info@hughjwardsolicitors.ie to request a time for a call back and one of our team will assist you.

What happens if I ignore debt recovery notice/legal demand?

Ignoring debt recovery notices can lead to more serious consequences, including legal action and a court judgment against you. This can damage your credit rating and lead to additional costs, such as court fees and interest.

What is a judgment and what does it mean for me?

A Judgment is a court order stating that you owe a certain amount of money. Once a judgment is made, creditors can take further steps to recover the debt, such as seizing property or wages. It can also negatively affect your credit rating.

What does Enforcement of a Judgment mean?

Enforcing a Judgment is a process through which the creditor can reclaim the amount that has been adjudicated by way of a court judgment.

What is a Judgment Mortgage?

A Judgment Mortgage is a formal charge registered over a property which will be payable to the creditor prior to any proposed sale of the property.

Can I settle my debt before it goes to court?

Yes, it is possible to settle the debt at any stage of the process, including before or during court proceedings. You can negotiate a payment plan or even settle for a reduced amount, though this depends on the creditor’s willingness.

What are the costs involved in the legal process?

Legal costs can vary depending on the value of the claim and the Court jurisdiction in which the claim has been filed, however they will usually include:

  • Court fees (If a claim has been filed with a court office).
  • Legal fees for representation or advice.
  • Additional costs if enforcement measures are needed.
  • Interest or penalties that accrue on the debt if it has remained unpaid.

Can my employer be notified if I have a debt?

Typically, employers are not notified directly about your debts. However, if a judgment order is made for wage garnishment, your employer will be legally required to comply with the court order and deduct the amount from your wages.

How do I avoid legal debt recovery in the future?

To avoid legal debt recovery:

  • Pay your debts on time.
  • Keep track of your financial obligations.
  • Engage and Negotiate with your Creditors early if you encounter payment difficulties.
  • Consider setting up direct debits or automated payments.
